O PRINCÍPIO DA SUBSIDIARIEDADE E A CARTA DA REPÚBLICA DE 1988: ELEMENTOS PARA DISCUSSÃO DA ADEQUAÇÃO NA SEARA ECONÔMICA

Abstract

This article aims to analyze the adequacy of the subsidiarity principle in the organization of the Brazilian State. Thus, based on the Constitution of the Republic of 1988, from the dialogue with founding principles of the republic, its dimension, materiality, effectiveness and scope are investigated, to denote the implicit form of the referred principle in the national order. In this sense, there is the assessment of the applicability of subsidiarity to govern the actions of the state entity in the economic field and promote the idea  statehood subsidiary. In the organization of the text, there is a deductive path, from the general to the particular. In brief final considerations, the finding that the constitutional legislator has elevated the state entity to the condition of necessary member, not restrictive, in the development of th econimic order,with attention to subsidiarity to consolidate the role of the state in balancing the relationship between public and private entities.
