Parameters for the right to education for citizenship

Abstract

Education is so important for a worthy life that it is recoginized as fundamental right by constitutions, such as the brazilian. Recently, the role of education as developer of citizenship has been highlighted on many essays, laws and cases. However, the methods of evaluating education as a right are still insuficient, what promotes juridic insecurity. There isn’t criterias that define if certain claim related to it must be provided or not. In that sense, this essay asks: how to know if the right to education for citizenship is being ensured? To answer this, the parameters for education for citizenship on Nussbaum (Capabilities Approach) and Satz (adequacy) were analyzed, establishing relations between them insofar they complement themselves. The studied parameters define that a education ensures that right when enables citizens to (1) not be dominated by each other; (2) to exercize their rights and freedoms; and (3) to integrate cooperative social contexts, with equitative access to leadership positions. This needs (4) absence of corrosive disadvantages and other factors (legal or not) that blocks or undermines the student’s learning. Therefore, it is necessary (5) to verify if the students really mastered what was taught to them. In this sense, (6) there are essential contents and abilities that every citizen must develop, like emotionality (for exemple: antiracism and patriotism); comprehension of society’s structure and history; capacity of cooperation; critical thinking; and argumentation – as well as abilities required by society’s complexity and competition. Parameters defined, interpretation of right to education for citizenship becomes clearer.
