HARD CASE IN THE LAW APPLIED IN MOZAMBIQUE: A FRONTIER BETWEEN LEGAL REALISM AND HARTIAN THEORY

Obedience to the constitutional order represents a water table of undeniable visibility in the construction of the collective imaginary, it results in the irradiation of the will of the Constitution before the applicators of the law and the society of interpreters, generating stimuli that purify the trigger of respect for the supremacy of the superlative and absolute norm of the legal system. The crisis of legal positivism stems from the incompleteness of the system, focusing on a lacunoso system in the resolution of certain demands. The preparation of law through the integration of moral agendas, foundations of post-positivism, conceives powerful instruments at the service of law and justice. The difficult cases are reflections of pragmatism that permeate the right put and that their correlation of force obstructs the passive judge, the one willing to bind - if literally the law. The lack of legal cover in the face of a specific case, fulminathe power of adjudication of the positivist judge, in the face of its passivity. The search for legal clarification, through the principle of the motivation of decisions, constitutes a real bank of proof and the purification of the democratic system, in such a way that its antagonism, as the use of discretion presupposes a huge danger to the legal castle and, therefore, the Constitution. This article proposes to reflect on the theory of judicial decisions in the face of difficult cases in Mozambique, demonstrating the intake of discretion proposed by Herbert Hart, in legal realism as a true attack on the constitutional order.
