CONTRACTING INTEGRATED IN THE DIFFERENTIATED CONTRACTING SCHEME: INADEQUACY OF THE THEORY OF IMPREVISION AS A CRITERIA FOR THE FINANCIAL ECONOMIC REBALANCING OF THE CONTRACT

The RDC determines a new procurement regime in Brazil. In this model, the bidding is formatted so that the private sector establishes design and build as well (DBTO contract), aiming to meet the performance levels required by the Government. The contract includes the integrated design and development of preliminary engineering; execution of works and services; assembly; the testing, the pre-operation, and all other measures necessary for the final delivery of the object. In RDC the private sector has to find an appropriate design and the Government has to find out a more efficient system. It will not be an easy task because in RDC there will still be a lot of information gaps; cost of transaction and “hold up” problems. Therefore, this text will examine the advantages and disadvantages of using such model.
