The work reflects on the normative content of the immediate applicability of the fundamental social rights enshrined in art. 5, paragraph 1, of the Constitution, especially addressing the issue of relevance of the lack of financial resources as the defining criterion limits the effectiveness of jusfundamentais standards. For this, a theoretical model is presented that gives insight and understand the various restrictions enforceable against the effectiveness of fundamental rights, scaling the scarcity of resources in harmony with the other applicability of variants in order to escape a superficial reading of the matter.
