Abstract

One of the roles of Public Ministry related in the Brazilian Federal Cons­titution is the duty to stand up in favor of public and social property. For the situa­tions where Government doesn´t take steps to ensure people´s rights involving public property by itself, the Brazilian Federal Constitution added two extra alter­native mechanisms: The Popular Act and The Public Civil Act. With those kind of requests, our citizens and The Public Prosecutor Office can defend the public and social interests, by replacing our government entities that were harmed, as if they were defending their own values. The legitimacy of The Public Prosecutor Office to fight for the public property is indubitable if we consider the fundamental position of the institution in the Brazilian legal order.
