TELECOMMUNICATION IN THE PUBLIC SECTOR: ESTABLISHING THE LINKS FOR THE BEST USE OF ITS BENEFITS

The purpose of this article is to analyze the extent to which the way teleworking is implemented in the Brazilian public sector has made it possible to maximize its potential as a work strategy for entering the digital age and recognition of human capital as the main agent of action aimed at results that meet public interest. The analysis was based on two aspects: the link of telework to the activity or task performed by the public agent and the control mechanisms for results arising from the performance of activities carried out under the telework mode, substituting the fixing of working hours. The content analysis of the rules that regulate teleworking and jurisprudence allowed us to conclude that there is still resistance to the assimilation of teleworking in all its breadth, which is verified, for example, in the hypothesis of the prohibition of teleworking to occupants of certain public positions. On the other hand, it is possible to affirm, based on the historical-evolutionary analysis of the administrative acts regulating telework in the public sector, that entities such as the National Council of Justice have already adopted reasonableness as a parameter for defining results goals for teleworkers and , in the same innovative sense, the Federal Audit Court already has a unit fully structured on a digital platform. Finally, as a contribution to the expansion of the teleworking institute, the possibility of adopting this work modality within the scope of tasks and activities related to government auditing is highlighted, reinforcing the thesis of linking teleworking to the nature of the task or activity.
