PSYCHIC ILLNESS AND SOCIAL CONSTITUTIONALISM: BURNOUT SYNDROME AS AN INDICATOR OF INSTITUTIONAL CRISIS.

This study proposes analyzes a critical and interdisciplinary analysis between Roberto Gargarella’s thought on Latin American constitutionalism and Burnout Syndrome as a social phenomenon. Based on the metaphor of the “engine room” of the Constitution, it argues that Latin American constitutions' power structure remains impermeable to enforcing social rights, directly contributing to workers’ psychological distress. The study adopts a qualitative and bibliographic methodology, showing that institutional inertia and democratic exclusion undermine the constitutional promise of decent work and mental health. In conclusion, the article proposes guidelines for a democratic restructuring of constitutional architecture in line with the rights guaranteed by law. Burnout, in this context, is understood as a symptom of the failure of social constitutions and the urgent need for structural reform.
